Dakota State University is obliged to provide a safe place of employment for all personnel, to ensure the integrity of university research and scholarship, and to conform to the requirements of state and federal law. All employees shall be subject to DSU Policy 02-74-00 on a drug-free workplace. Dakota State University also provides resources for all who are experiencing problems with or would like to learn more about substance use.

State and federal policies proscribe dating violence, domestic violence, sexual assault, and stalking, often treating such actions as criminal offenses. These forms of misconduct interfere with the ability of victims to realize the benefits of the educational, cultural, and social programs offered by the universities and special schools. Any student, employee, or other person participating in institutional activities or using institutional facilities who engages in conduct that would constitute dating violence, domestic violence, sexual assault, or stalking, as defined in this policy, or sexual assault, domestic abuse, or stalking, as defined under South Dakota law, in circumstances that implicate the person’s fitness to study, work, participate in the functions, or use the facilities at the institution may be expelled, terminated, denied further participation in institutional programs or use of institutional facilities, or otherwise disciplined, upon notice and opportunity to be heard. The decision to pursue disciplinary charges of dating violence, domestic violence, sexual assault, or stalking will not preclude pursuit of additional, related charges arising from the same facts. The educational, research, and service missions of the institutions controlled by the Board of Regents are more easily achieved when institutional employees, students, and visitors enjoy a safe and secure environment. Violence in any form is unacceptable within the institution. In keeping with recommendations issued by federal and state law-enforcement authorities, the board requires that each institution provide for the routine threat-assessment review when a student, employee, or visitor exhibits forms of disturbing behavior that suggest that the individual is planning or preparing a violent attack involving the institution or persons associated with it. The procedures required under this policy apply to reports that students, faculty, staff, volunteers, or visitors have exhibited disturbing behavior as defined in this policy. University faculty members may not have consensual relationships with any students under their academic supervision. See SD BOR Policy 1.4.2.
